For some insane reason, Nicholas Elizondo, a convicted sex offender who raped his 6-year-old step daughter, has been granted sole custody of his biological daughter by an Oklahoma judge.

The worst part? His biological daughter is the same age his step daughter was when he abused her, 6--AND poor little Sarah already came home once telling her mom that her 19-year-old step brother had touched her in a "bad place" when she was taking a bath.

So, how did this terrible court decision even happen?

Well, apparently Elizondo, 55, filed for sole custody when his ex-wife Lisa Knight stopped allowing him to visit their daughter, Sarah.

"I don't understand how a sex offender can just walk in the courtroom and just take her after I've had her for six years," Knight wondered after the verdict was announced.

There is speculation that Oklahoma County Judge Howard Haralson retaliated against the mom because he felt like the last minute claims from the little girl about being touched innapropriately was fabricated, which just makes no sense! I mean, who cares if it was fabricated or not, the fact of the matter is that her father gave up his right to ever be alone with another child the moment he decided to abuse his own helpless 6-year-old stepdaughter 10 years ago. 

UGH, I have NO IDEA what could be going on in any adult's head in order to make the incredibly stupid decision to send a poor, defenseless child to live with a documented sexual predator. The little girl's mom is obviously distraught about the situation, arguing that not only is it dangerous to have a little girl the EXACT SAME AGE as his last victim living under Elizondo's roof, but also that his conviction essentially means that Sarah will never be able to live a normal childhood with her biological father due to his conviction.

"I just know that his victim was 6 years old at the time and Sarah is 6 years old right now," said Knight.

"He can't take her to Chuck E. Cheese. He can't take her to a park," Knight's cousin lamented. "He can't go to her school. He's not allowed in school."

omg no no no this little girl can't live with this man.  this is the most ignorant decision . Is there any possibility of this little girl getting out of that home if someone appeals the judge decison. I hope.  I pray for the safety of this child

OMG..Is EVERYONE losing their common sense? And I'm ashamed that judge is in my state. Personally, I think ALL pedophiles need to be on their own lil island that is marked for bomb testing site.

hell now wtf was the judge think letting his kid live with him knowing hes a sex offender well looks like he gonan do it again to his kid and no one cares what a messed up world to let a sex offender have custody where the justice in this
what is wrong with this judge? when are these judges going to be held accountable for these decisions that they make that endanger young children? why on gods earth would he allow a convicted sex offender custody of a girl the same age of the girl he was convicted of abusing, whether he thought she was making it up or not? why take that chance? They need to remove this judge from the bench until he gets his head out of his ass! Maybe we should send the judges daughter to go stay with the guy and see if he is happy then. That is, if the judge has a daughter. It is decisions like this that make people distrust the judicial system!! All I can tell the mother is to appeal, but I would call Child Protective Services in the interim... there has to be a reason that the judge chose the dad over the mom. I would rather my daughter be with CPS than a child molester!!! ANY DAY!!
Unfortunately he will be allowed to his daughters school functions but only if it has to do with his daughter. We ran into a situation like that where we used to live and that's what was explained to us.

This judge should be removed from the bench! And if this little girl is molested the mom should sue the court as well! This just must be some kind of pervert himself!

To the mother of this little girl: I would try to get this decision appealed. I would also call CPS (or DCS, whatever the child welfare agency is called in your area) and have them to check up on your daughter, especially since she's made a claim against her 19 year old stepbrother. I know it's hard, but you have to keep fighting - this judge's ruling does not have to be the final say.
